Podcast: Bylaw Blog’s John Infante on Penn State and the NCAA

The release the Freeh Report on the investigation into Jerry Sandusky and the Penn St. football program rocked the college football world last week. The unprecedented level of impropriety alleged in the report strengthened the calls for criminal charges against members of the Penn St. administration, as well as investigations into the school by the Department of Education and Department of Justice. The report also raised the question of whether or not the NCAA should investigate and potentially punish the school’s athletic department. John Infante of the invaluable Bylaw Blog joins Crystal Ball Run managing editor Allen Kenney for a podcast to explore the options available to the NCAA and what might be some of the appropriate ways for the NCAA to address the situation (if at all).

John and Allen discuss:

  • Whether or not this is a “football problem.”
  • The NCAA’s potential justification for involvement.
  • Existing precedent related to the case and the possibility of creating new precedent.
  • Infante’s discovery of a little-known procedure for kicking Penn St. out of the NCAA.
  • The ripple effects of the scandal across college athletics.
  • And more.
